- SPONSOR: Disney Destinations, LLC, P.O. Box 10000, Lake Buena Vista, FL 32830 (“Sponsor”).
- ADMINISTRATOR: Ventura Associates International LLC, 60 East 42nd Street, New York, NY 10165 (“Administrator”), an independent judging organization whose decisions are final and binding with respect to this sweepstakes (“Sweepstakes”).
- ELIGIBILITY: Open only to persons who are legal residents of, and physically located within, the 50 United States or D. C. (“Territory”) who are 18 years of age or older or the age of majority in their state of primary residence (whichever is older) as of Entry. Employees of the Sponsor, Administrator, its parent, subsidiary, affiliated and successor companies, or the advertising, promotional or fulfillment agencies of any of them (individually and collectively “Entities”), and the members of their households and members of their immediate families (defined as parent, child, spouse, siblings and the spouses of each) are all ineligible to participate in the Sweepstakes.
- ENTRY: Commencing at 1:00 P.M. (ET) on May 19, 2015, and ending at 3:00 P.M. (ET) on May 19, 2015 (“Entry Period”), subject to the limitations below, you may enter this Sweepstakes by [a] visiting the Disney Parks blog post found here: https://disneyparks.disney.go.com/blog/2015/05/tomorrowland-24-hours-at-walt-disney-world-resort – sweepstakes (“Blog” or “Website”) to learn about the Sweepstakes, and [b] sending us an email with “24 Hours in the Park” in the subject line to WDWMeetUps@gmail.com (“Entry”). Your Entry must state your valid email address (“Address”), if you will be bringing a guest (only one guest is permitted) and full name, as all Entries without a valid first and last name will be discarded. For purposes of these Official Rules (“Rules”), all times and dates are Eastern Time. Normal Internet access and usage charges imposed by your online service will apply. It is your sole responsibility to notify the Sponsor in writing if you change your Address.
- LIMITATIONS: Entries are limited to one Entry per person per Address. In the event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the natural person in whose name the Address is registered. Entries by any method other than set forth above in Paragraph 4 are void. Any use of automated or programmed methods of effecting Entry is prohibited. Neither the Entities, nor any of their officers, directors, shareholders, employees, affiliates, agents or representatives (individually and collectively, “Releasees”) are responsible for Entries from persons residing, or physically located, outside the Territory; Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, late, lost, misrouted, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Rules; inaccurate or incomplete capture online of Sweepstakes entry information; lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable emails resulting from any form of active or passive email filtering; insufficient space in your email account to receive email; or other errors of any kind, whether due to electronic, human, mechanical, printing, production, technical errors or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified, and any attempt by a person to use multiple email accounts to register more than once may result in disqualification at Sponsor’s sole discretion. Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations.
- PRIZES (“Prize” or “Prizes”): Two hundred fifty (250) Prizes: Each Prize winner (“Winner”) will receive: [a] breakfast for Winner and one guest (“Guest”) to take place on May 22, 2015 at Tomorrowland Terrace in Tomorrowland at Magic Kingdom® Park at the Walt Disney World® Resort that will include photo opportunities; [b] admission for Winner and one (1) Guest to see a screening of Disney’s mystery adventure movie “Tomorrowland” to take place at AMC Downtown Disney 24 on May 22, 2015; [c] a 1-Day, 1-Park ticket for Winner and Guest to spend 24 hours at Magic Kingdom® Park on May 22, 2015, and [d] one (1) standard car parking provided to each Winner to permit admission (at no cost to Winner and/or Guest) to the Magic Kingdom Park to participate in the Prize. Transportation to and from the event is not included. All expenses not specifically mentioned herein are not included and are solely each Winner’s responsibility, including but not limited to: transportation to Magic Kingdom Park, gratuities and tips and merchandise. Approximate retail value (“ARV”) of each Prize: $291.26. Total ARV for all Prizes: $72,815. Limit one Prize per person per Address. If the actual value of the Prize is less than the stated ARV, the difference will not be awarded. Any depiction of Prize is for illustrative purposes only. Prize is not redeemable for cash or transferable. No substitution allowed except, at Sponsor’s sole discretion, a Prize of equal or greater value may be substituted. Sponsor will not replace any lost or stolen Prize. A Prize cannot be used in conjunction with any other promotion or offer. Prize elements may not be separated. Only the number of Prizes stated in the Rules is available to be won. All Prizes will be awarded provided a sufficient number of eligible Entries are received and Prizes are validly claimed by May 20, 2015, after which no alternate Winners will be selected, nor unclaimed Prizes awarded. In the event that a Prize component is not available for any reason, the remaining elements of the Prize shall constitute full satisfaction of Sponsor’s Prize obligation to Winner and no additional compensation will be awarded. All federal, state and local taxes on Prizes are the sole responsibility of each Winner. Guest may be under 18 years of age, but if Guest is under 18 years of age, s/he must be accompanied by Winner who must be parent or legal guardian.
- PROCEDURES: All Entries must be received during the Entry Period. In a random drawing on or about May 19, 2015, the potential Winners will be selected from all eligible Entries received. Odds of winning depend on the total number of eligible Entries received.
- WINNERS: Potential Winners will be notified by email on or about May 19, 2015. Each Winner must present a copy of his/her winning email with valid photo ID for admission at the designated date and time. Valid photo ID currently includes a government issued driver’s license or passport, school ID or valid Disney-issued annual pass (“Annual Passport”) [see https://disneyland.disney.go.com/passes/ for more details on the Annual Passport]. At the sole discretion of the Sponsor, disqualification and forfeiture may result from any of the following: [a] falsification of Guest information or submission of more than one Entry; [b] potential Winner’s failure to present a copy of his/her winning email with valid photo ID on date and at time of Prize; [c] potential Winner’s failure to provide Sponsor with satisfactory proof of age, identity, and residency; [d] potential Winner’s failure to redeem a Prize on the designated date and time; [e] the return of an email notification as undeliverable after three (3) attempts, and [f] any other non-compliance with Rules. In the event of a Prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited Prize to an alternate Winner.
- PRIVACY POLICY/DATA COLLECTION: Information provided by you under this Sweepstakes is subject to Sponsor’s privacy policy located at https://disneyprivacycenter.com (“Privacy Policy”).
- CONDITIONS: By entering this Sweepstakes and/or accepting any Prize you may win, you agree that: [a] you will be bound by the Rules, Privacy Policy and the Sponsor’s decisions, which shall be final in all respects; [b] the Entry becomes solely the Sponsor’s property and will not be acknowledged or returned; [c] you release and hold harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any Prize; participation in the Sweepstakes or any Sweepstakes-related activity or travel or from any interaction with, or downloading of, computer Sweepstakes information; [d] the Releasees do not make any representation, warranty or guarantee, express or implied, relating to the Sweepstakes or the Prizes; [e] Winner’s acceptance of any Prize constitutes the grant to Sponsor and assigns of an unconditional right to use Winner’s name, address (city and state only), voice, likeness, photograph, biographical and Prize information, statements about the Sweepstakes and/or live and taped performances of interviews for any programming, publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; [f] in the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor’s reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of the Sweepstakes, so that it cannot be conducted as originally planned, Sponsor has the right, in its sole discretion, to modify the Rules or to cancel, modify, terminate or suspend the Sweepstakes; and in such event, to select Winners by such method as Sponsor in its sole discretion shall consider equitable; [g] the Releasees are not responsible for typographical or other errors in the offer or administration of this Sweepstakes, including but not limited to: errors in the advertising, Rules, selection and announcement of the Winners and distribution of the Prizes; [h] any part of any Prize not accepted or used by any Winner will be forfeited; [i] the Releasees are not responsible for any inability of any Winner to accept or use any Prize (or any portion thereof) for any reason; [j] the Sponsor has the right, at any time and at its sole discretion, to disqualify any individual it suspects to be doing any of the following: (i) tampering or attempting to tamper with the Entry process or the operation of the Sweepstakes; (ii) violating the Rules; (iii) violating the terms of service, Privacy Policy or other terms, conditions of use and/or general rules or guidelines of any Sweepstakes property or service; (iv) acting in bad faith, unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or (v) for any other good cause as determined solely by the Sponsor; [k] since any attempt by any individual to deliberately undermine the legitimate operation of the Sweepstakes is a violation of these Rules as well as criminal and civil laws; and should Sponsor believe or become aware that such an attempt has been, is being, or will be made, it has the right to seek remedies and damages from any responsible individuals to the fullest extent permitted by law, including without limitation criminal prosecution; [l] all disputes, claims and causes of action at law or in equity (individually, “Claim”) arising out of or relating to this Sweepstakes, the meaning or interpretation of the Rules or any Prize awarded shall be resolved by applying the laws of Florida, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in the state or federal courts within that state; [m] any Claims shall be resolved individually, without resort to any form of class action; [n] any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees, and under no circumstances will any entrant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and all rights to have damages multiplied or otherwise increased; [o] Winner’s acceptance of the Prize constitutes the grant of an unconditional right to Sponsor and assigns to photograph, film, or otherwise capture the fulfillment of the Prize (“Fulfillment Film”), and Sponsor shall have the unconditional right to reproduce, distribute, display, exhibit, transmit, broadcast, stream, synchronize with visual material, modify, amend, create derivative works, and otherwise use and permit others to use the Fulfillment Film throughout the universe in any and all media now known or hereafter devised, in all languages and in all versions, in perpetuity, without compensation, except where prohibited by law; [p] Sponsor’s use of the Fulfillment Film will not give rise to any claims of infringement, invasion of privacy, defamation or claims for performance or payment of any kind, including but not limited to payment of re-use fees, residuals or license fees; [q] Sponsor shall have the right to make such changes to the Fulfillment Film and make such uses thereof as it deems necessary or desirable, including but not limited to the right to use, edit, and reproduce and/or alter said Fulfillment Film in perpetuity, in its entirety or in part, for any commercial and promotional purposes worldwide without any consultation or additional permission, or compensation, credit or attribution; [r] Sponsor has the right to modify Prize award procedures at its sole discretion, and [s] the Prize cannot be sold.
